1. Agreement and parent responsibility

These Terms govern use of MotionPlay and its related services. A parent or legal guardian must review these Terms and supervise use by a child. By installing, purchasing, or allowing a child to use MotionPlay, the responsible adult agrees to these Terms.

2. What MotionPlay provides

MotionPlay provides games and interactive experiences that may use touch or camera-recognised movement as controls. Features, supported devices, game availability, and free or paid access may change as the product develops.

3. Safe use

Use MotionPlay in a clear, stable, well-lit space away from traffic, stairs, sharp objects, fragile items, and other hazards. Use movements that feel comfortable. Stop immediately if a player experiences pain, dizziness, fatigue, imbalance, or discomfort. Children should be supervised appropriately.

MotionPlay is entertainment software. It is not medical care, physiotherapy, diagnosis, treatment, or a substitute for professional advice.

4. Camera permission

Motion controls require camera permission. The camera can be stopped or permission can be withdrawn through device settings. Some gameplay features may not function without permission. Camera handling is described in the Privacy Policy.

5. Purchases and subscriptions

Native purchases are completed through Apple App Store or Google Play and are subject to the store’s terms, billing interval, renewal rules, refund process, taxes, and account controls. Prices and available plans are shown by the store before purchase. Parents are responsible for securing store authentication and purchase controls.

Deleting the app does not automatically cancel a subscription. Use the relevant store account to manage or cancel it. Restoring a purchase restores eligible store access but does not restore deleted local game progress.

6. Acceptable use

Do not misuse MotionPlay, attempt to bypass purchase or security systems, disrupt services, reverse engineer protected components except where law permits, infringe another person’s rights, or use the service for unlawful purposes.

7. Intellectual property

MotionPlay, its games, artwork, software, names, and original content are owned by or licensed to AzharLabs and are protected by applicable intellectual-property laws. These Terms provide a limited, personal, non-exclusive, non-transferable right to use the app; they do not transfer ownership.

8. Availability and changes

We may update, add, remove, suspend, or discontinue features for safety, legal, technical, or product reasons. We aim to preserve earned local progress where practical but cannot guarantee uninterrupted operation, compatibility with every device, or permanent availability of every feature.

9. Disclaimers

To the extent permitted by applicable law, MotionPlay is provided “as is” and “as available.” We do not promise that movement recognition will be perfect in every environment, that the app will be error-free, or that it will achieve health, learning, or developmental outcomes.

10. Limitation of liability

To the extent permitted by law, AzharLabs is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of MotionPlay. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded, including mandatory consumer protections.

11. Privacy

The Privacy Policy explains how MotionPlay handles camera processing, local information, purchases, support communications, retention, and family choices.

12. Changes to these Terms

We may update these Terms as MotionPlay or applicable requirements change. The effective date will be updated. If a material change requires new consent, we will provide an appropriate parent-facing notice.
